Naftogaz loses control over pipeline, says Gazprom must pay for transit
Journal Staff Report

KYIV, May 11 – Naftogaz Ukrayiny, which notified Gazprom of the impossibility of further transit through the territories occupied by the Russian Federation and offered it to change its entry point, expects Gazprom to continue paying for any decision, Head of NJSC Naftogaz Ukrayiny Yuriy Vitrenko has said.

In 2019, Miller and I signed a transit contract with the "take or pay" provision. Therefore, whether to supply gas for transit is the right of Gazprom to decide. But to pay, even if you do not supply gas, it is an obligation under the contract," Vitrenko wrote on Facebook.

He said that if there is no payment, "it looks like there should be a new arbitration."

Can we do it again?" the head of Naftogaz, who already had a successful experience of the Stockholm arbitration with Gazprom, said.

The Gas Transmission System Operator of Ukraine (GTSOU) has repeatedly warned Gazprom about the threats to transit due to the actions of the occupation forces controlled by Russia, and demanded to stop interference in the operation of the facilities, but these appeals were ignored.

As a result, on May 10, the GTSOU reported the occurrence of force majeure circumstances that make it impossible to further transport gas through GMS Sokhranivka and the Novopskov border compressor station (CS), which are located in the occupied territory of Luhansk region.

In this regard, GTSOU notified Gazprom that starting from 07:00 on May 11, 2022, To fulfill its transit obligations to European partners in full and following the terms of the agreement, it is possible to temporarily transfer unavailable capacity from the Sokhranivka physical interconnection point to the Sudzha physical interconnection point located in the territory controlled by Ukraine.

Gazprom rejected on Tuesday the grounds for Kyiv's declaration of force majeure on transit, and announced the impossibility of redirecting volumes. (om/ez)
