Constitutional Court upholds ban on use of tainted evidence
Journal Staff Report

KIEV, Oct. 24 – Criminal charges cannot be brought using evidence obtained without respect to the constitution or in violation of the law, the Constitutional Court of Ukraine has announced.

The court announced this decision after considering an appeal of the Security Service of Ukraine, which asked the Constitutional Court to give an interpretation of a statement in Article 62, part 3 of the constitution: "Charges cannot be based on evidence received unlawfully."
